If the Jammie Thomas (US$222k for sharing a few dozen songs; a verdict blessed by the Bush and Obama administrations) case sets a precedent, this surely shouldn't be prosecuted as if it were a common domestic burglary, but should be regarded as the equivalent of handing out devices that made perfect copies of dollar bills to anyone who asked for one. Currency counterfeiting is an act of war under international law; so under this, TPB are non-state agents waging economic war against the US and other countries, or not to put too fine a point on it, economic terrorists.
